Court Martialled Indian Army officer finally taken back into services after 26 Years, Rs 5 Crore fine on MOD

Justice is surely delayed, but not denied. This time it was proved for an Indian Army officer.

An Indian Army officer who was court martialled 26 years before in 1991 has been reinstated into the services after the judgement passed by the Armed Forces Tribunal (AFT). Quashing all the charges against him, the tribunal has ordered the Ministry of Defence to restore him into the services. Tribunal has also imposed a fine of rupees 5 crore on the Ministry of Defence. SS Chauhan, who is native of Uttar Pradesh's Mainpuri district, was a second lieutenant posted in Srinagar in Sixth Rajput Battalion of the Indian Army at the time when he faced charges. He was declared a deserter and mentally unstable.

Armed Forces Tribunal passed the final judgment on 19-01-2017 and quashed all the charges for which he was court martialled. Justice DP Singh and Air Marshal Anil Chopra have the Ministry of Defence to take him back in the services and to provide him the promotional avenues up to the stage of Lt. Col. He will also get other benefits like salary arrears, pension and official rank.

MoD has to give Rs 4 crore to SS Chauhan and also has to deposit Rs 1 crore in Army Central Welfare Fund within a period of four month.

Chauhan was court martial on 4th Nov, 1991. His trial began when 147 Gold biscuits weighing more than 27 kgs were recovered during a search operation. Chauhan admitted it in his petition that the biscuits were recovered at a part operation in a house in presence of other soldiers.

Finally, the senior officers of the tribunal found that he was implicated in a false case. They have asked the Chief of Army Staff General Bipin Rawat to look into the matter in order to ensure that the action is taken against those who are found guilty of falsifying the case.
